MyMedClaims - Terms of Use


This Agreement, is made and entered by MyMedClaims, ("MyMedClaims"), and you, ("User").

Intending to be bound in accordance with the terms hereof, the parties agrees as follows:

Commercial Advertising (Spam)

  1. You must not use any reference to MyMedClaims in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited faxes or email messages. This prohibition extends to the sending of unsolicited mass mailings from another service that in any way implicates the use of any MyMedClaims service or email address. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making one's email address accessible to the public will not constitute a request or invitation to receive messages.

    If you are found to have spammed, we reserve the right to immediately, without warning, disable your account. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

    Spamming (the sending of unsolicited email or faxes) is STRICTLY prohibited. None of the following will be tolerated.

    • You may not send any unsolicited email or fax mentioning our web or email address
    • You may not send any unsolicited email or fax mentioning our IP address
    • You may not post a commercial message in a non-commercial newsgroup
    • You may not post advertisements on IRC chat that result in complaints

    Spammers are caught 100% of the time in the present internet. Though still not unlawful in some places, it is now possible to press civil charges for spam. The penalty can be a monetary value as much as $25,000 in some states in the US. If you are unable to pay the fines levied against you by the courts, you are considered "In Contempt" of the court, and can get 60-750 days in jail. Here are just a few examples of what can be considered as spam:

    • Sending any unsolicited commercial email, even a single one
    • Sending bulk email-yes, the vendors of these lists tell you it's not spam but it is
    • Subscribing to a safelist more than once. This sounds harsh, but it's the reality, especially if you are placing the same ad which makes it very easy for the moderator to track you
    • Sending your ad more times than is specified in the list guidelines
    • Using an autoresponder address to subscribe to safelists
    • Responding to a safelist offer with your own ad, either through the safelist or directly to an individual
    • Resubscribing once you have been unsubscribed from a list due to violation of list guidelines
    • Any other unsolicited message for commercial purposes

    MyMedClaims will be the sole arbiter as to what constitutes a violation of this provision.

Service Abuse
  1. Any attempts to undermine or cause harm to any MyMedClaims server or any customer of MyMedClaims is strictly prohibited.
  2. Customers may not use the MyMedClaims network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, or password cracking. Customers may not attempt to interfere or deny service to any user. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a server or network. MyMedClaims will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Payment for Service

Your annual billing date will be set as the first of the month following your two-month free trial period (if taken), or the first of the month following your sign-up date.
  1. After any free trial period has ended, User agrees to pay in advance for services rendered.
  2. User agrees to pay the renewal charges on or before the first day of the anniversary of the initial paid period.
  3. User agrees to pay a $20 fee for any returned checks, for any reason.
Each year’s journal will be retained and accessible to current subscribers through May 31st of the following year, for updating and printing. It will then be deleted.

Appromimately two weeks prior to your annual billing date, an E-mail will be sent to you, notifying you of the upcoming billing date and the amount due. This will also be displayed in the "Your MyMedClaims account" data on the web site. Payments will be handled per your account settings (from the "Your account" page).

If your payment method selection is by Check:

Mail your check for the full Amount Due so that it is received by your Annual Billing Date.

For proper credit, include on your check:
     - Your Affiliate ID Number
     - Your Email Address

Make your check payable to "MyMedClaims" and mail to:

If your account has an outstanding Amount Due after your Annual Billing Date, your account status will be Past Due. An Email will be sent to you, requesting you to advise us of your intentions by return Email. You may send your check, or change your payment method to Credit Card in the "Your MyMedClaims account" data at the web site.

If your check is received for an amount LESS than the Amount Due:
     It will be credited to your account.
     An Email will be sent to you requesting the additional amount.
     Your account status will be "Past Due" until full payment is received.

If your check is received for an amount MORE than the Amount Due:
     It will be credited to your account.
     The excess payment will be treated as a Referral Credit, which will be returned to you in accordance with the Affiliate payment policies.

If your check is returned from the bank for any reason, a $20 returned check fee will be added to your Amount Due, in addition to reversing the amount of the returned check.

If your payment method selection is by Credit Card:

On your Annual Billing Date, the Credit Card information you entered on the "Your MyMedClaims account" page will be used to authorize payment of your Amount Due.

If the authorization of your Credit Card is declined, your account status will be Past Due. An Email will be sent to you, requesting you to advise us of your intentions by return Email. You may access the MyMedClaims web site to update your Credit Card information, or change your payment method to Check in the "Your MyMedClaims account" data at the web site.

Term and Termination

If your payment is to be made by credit card and authorization is declined, you will be notified by email. If your payment is to be made by check and it is not received by the billing date, you will be notified by email. If your payment becomes 28 days past due, your account will be terminated and you will lose access to your journals.
  1. This agreement shall have an initial term of one year from the date of execution hereof. Upon expiration of such term, this agreement shall automatically renew for successive equivalent periods, unless notice is given by either party of its intent to terminate the agreement prior to the scheduled renewal date. All terms and conditions of this agreement shall be in full force and effect during all original and renewal periods hereunder.
  2. Customers wishing to cancel service must do so online. No cancellation requests will be accepted by email or telephone for security reasons. No further renewal charges will occur once you have cancelled service.
  3. No refunds are given for prepaid periods.
  4. MyMedClaims reserves the right at its sole discretion to refuse or cancel service. Violation of any of MyMedClaims' Terms of Use could result in a warning, suspension, or possible account termination. Accounts terminated due to policy violations will not be refunded.

Indemnification of MyMedClaims/Relationship of Parties

  1. Customer agrees that it will protect, indemnify, save and hold MyMedClaims harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable attorney's fees assessed against MyMedClaims, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it's customers, affiliates, employees or assigns.

Disclaimer

  1. MyMedClaims will not be responsible for any damages you or your business may suffer. MyMedClaims makes no warranties of any kind, expressed or implied for services we provide. MyMedClaims disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by MyMedClaims and its employees. MyMedClaims reserves the right to amend or update these policies without notice. Failure to follow any terms and conditions may result in account deactivation.

    MyMedClaims wishes to emphasize that in accepting services, customers indemnify MyMedClaims for the violation of any law or MyMedClaims policy, that results in loss to MyMedClaims or the bringing of any claim against MyMedClaims. This means that if MyMedClaims is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against MyMedClaims, plus costs and reasonable attorneys' fees.

Governing Law, Arbitration, and Venue

  1. This Agreement will be governed by and construed in accordance with the laws of the State of Pennsylvania. Any disputes arising under this agreement will be resolved by binding arbitration, to take place in Union County, Georgia.

Violation of any terms or conditions are grounds for immediate account deactivation, with no refunds given.
We reserve the right to refuse or cancel service at our sole discretion.
